State of emergency in Peru - January 2023: when does the measure start and in which departments and provinces is it governed? (Spanish)

Dina Boluarte by virtue of her powers as exceptional representative, and constitutional succession of the Republic of Peru, and due to the continuation and expansion of the mobilizations, and demonstrations against her government, decreed with the approval of her ministerial cabinet, State Emergency in various departments, provinces, and even some highways belonging to the National Road Network. We tell you what the measure consists of, how it will be applied, and until when the norm that also establishes another curfew in Puno will be complied with.

WHAT DOES THE NEW SUPREME DECREE ESTABLISHED BY THE PRESIDENT OF PERU DETERMINE?

On Saturday, January 14, the official newspaper El Peruano published Supreme Decree (DS) No. 009 that determines and declares the suspension of the exercise of constitutional rights in three departments, four provinces, one provincial district, and five highways and corridors through charge of the Ministry of Transport and Communications (MTC), starting the following day, and for thirty calendar days.

The reason for this decree lies in the considerations established by the Magna Carta, and recommendations by the General Command of the National Police of Peru (PNP) to protect the population, safeguard the integrity of citizenship, guarantee and restore control internally , and likewise, recover order in various regions of Peru that has been altered due to the wave of deaths , and damage to private property since December 2022 .

One of the articles also states that the department of Puno continues to comply with the mandatory social immobilization of the people who live in its city for a period of ten calendar days from eight at night to four in the morning.

WHICH ARE THE DEPARTMENTS, PROVINCES AND ROADS THAT HAVE BEEN DECLARED IN A STATE OF EMERGENCY IN DS Nº 009?

From Sunday, January 15 to Friday, February 24, 2023, the PNP with the support of the Peruvian Armed Forces (FF.AA.) will have the power to maintain control of internal order as established in articles 1 and 2 of SD Nº 009 that declare the State of Emergency in Puno, Cusco, and Lima.

Similarly, the areas considered at high risk by the Peruvian government are the Constitutional Province of Callao, the province of Andahuaylas in the department of Apurímac, the provinces of Tambopata and Tahuamanu in Madre de Dios, and the district of Torata located in the province of Marshal Grandson of Moquegua

Article 2 also declares in a State of Emergency, and for the same period of thirty calendar days, the entire Panamericana Sur, Panamericana Norte, Carretera Central, Corredor Vial Sur Apurímac-Cusco-Arequipa, and the Corridor Vial Interoceánica Sur.

The norm establishes that in these regions and cities, except for highways and corridors, freedom of assembly and transit will be interrupted, and law enforcement will be empowered to intervene in any home if required.
