Peru: government decrees State of Emergency in seven regions due to protests (Spanish)
The Executive Power ordered a new State of Emergency for a period of sixty calendar days. In Puno, a curfew from 8:00 p.m. to 4:00 a.m. for 10 days has also been decreed.
The Executive decreed a state of emergency for 60 days in Madre de Dios, Cusco, Puno, Apurímac, Arequipa, Moquegua, and Tacna (source Andena)
The government of President Dina Boluarte today (Sunday) decreed a State of Emergency in the regions of Cusco, Madre de Dios, Puno, Apurímac, Arequipa, Moquegua, and Tacna due to the social and political crisis that has been experienced since last December 7th in the country.
The measure was made official in an extraordinary edition of the Official Gazette El Peruano and has the signatures of the President of the Republic, Dina Boluarte; of the Premier Alberto Otárola; Defense Minister Jorge Luis Chávez Cresta; and the Minister of Justice, José Tello.
Scope of the measures
According to the Supreme Decree, the State of Emergency will last for sixty calendar days in the seven mentioned regions. During this period, the National Police of Peru (PNP) "maintains control of internal order, with the support of the Armed Forces" (FF.AA.) and will have as its objective the "protection of National Critical Assets."
In addition, basic individual rights related to the inviolability of the home, the freedom of transit through the national territory, freedom of assembly, and personal freedom and security as established in the Political Constitution of Peru are suspended.
It should be noted that the State of Emergency has additional specific restrictions in the Department of Puno where measures have already been in place since January 14th. Within Puno, the regulations specify "the control of internal order is in charge of the Armed Forces, incorporating the PNP (...) in the area declared in a State of Emergency,"
Likewise, in Puno the mandatory social immobilization (i.e. curfew) "of all people in their homes" will be in force for ten calendar days from 8:00 p.m. until 4:00 a.m.
The Decree further specifies that, during mandatory social immobilization, people may circulate for the "acquisition, production and supply of food", as well as health personnel and others who are essential for the continuity of economic activities and water services, sanitation, agriculture, surveillance and security, financial services, etc.
The Supreme Decree also provides that in Puno, the Joint Command of the Armed Forces. "assume the Unified Command of the Armed Forces and the National Police". This measure is similar to the 1981 State of Emergency declared by President Fernando Belaúnde Terry which led to military law superseding civilian law.
Finally, the regulations provide that, within five business days after the end of the State of Emergency in the seven regions, the PNP must submit to the Minister of the Interior a "detailed report on the actions carried out during the emergency regime."
Likewise, the Unified Command of the Armed Forces and the National Police in the department of Puno must present a similar report, within the same period, addressed to the Ministers of the Interior and Defense.
