Peru: Constitution Commission archives project of Dina Boluarte on early elections (Spanish)

After raising a point of order by Alejandro Cavero, the Constitution Commission ordered debate on the advancement of elections delayed until July 2023.

The Constitution Commission of Peru's Congress, chaired by the Fujimorista Hernando Guerra García, archived the constitutional reform project proposed by the government of President Dina Boluarte on the advancement of general elections for October 2023. The new initiative proposing cutting short the current presidential and congressional mandates could be evaluated after July 27 of this year when another annual period of sessions begins.

The project was rejected after a point of order strategically raised by Avanza País Congress Member Alejandro Cavero, who asked that a vote be put to whether the Constitution Commission could debate an initiative similar to one that was already dismissed in the legislature's current plenary session. The request did not achieve the fourteen votes necessary for consideration.

Cavero raised the appeal after rejecting a previous question from the Acción Popular Congress Member Ilich López.

Cavero Alva and López Ureña presented their requirements based on the second paragraph of Article 78 of the Regulations of Congress: "If the bill or legislative resolution is rejected, the president will order its filing. on the same matter until the next annual period of sessions, unless agreed by half plus one of the legal number of congressmen."

In this way, a project to advance elections cannot be debated until the first legislature of the new annual period of sessions begins next July.

Project support

The government project was supported by Minister of Justice and Human Rights, José Tello who urged the Legislature to take a position of "dialogue, conversation and hope."

Also present were the President of the National Elections Jury, Supreme Judge Jorge Luis Salas Arenas; the head of the National Office of Electoral Processes (ONPE), Piero Corvetto; and head of the National Registry of Identity and Civil Status (Reniec), Carmen Velarde.

Former President Martin Vizcarra's comments on Twitter

After the (in)action by the Constitution Commission, Former President Martin Vizcarra took to Twitter to denounce to Congress members yjr involved and call for current President Dina Boluarte's resignation:

"The indolent congressmen broke all records, they rejected 4 projects to advance the elections in a week, now does anyone have a doubt that they do not want to leave?
#DinaRenunciaYa, Art. 115 of the Constitution, FORCES congress to call elections immediately."
